The buyer of this
puppy/dog described above, I/we agree to the following terms and conditions:
AMERICAN KENNEL CLUB
registration (circle one):
FULL LIMITED
****If sold with a
limited registration the dog is NOT to be used for breeding. It has
been explained to the Buyer and it is understood that no offspring of this dog
can be registered by the AKC. The Buyer
also agrees to spay/neuter the dog no later than 12 months of age. Proof of spay/neuter will be mailed to the
Seller at the above address. The Buyer binds them self to take proper
precautions that the dog is not accidentally bred or used for breeding before
being altered. If the dog is bred and
produces puppies, the Buyer agrees to pay the seller an additional $1,500.00
cash and return the dog and all puppies back to the Seller.
1)
I/we agree to give proper care emotionally, physically and
nutritionally as well as keeping all medical up to date including shots,
heartworm, flea control and any emergency care/treatment needed.
2)
I/we agree to raise and train this Great Dane to become a
good canine citizen and a loved and obedient member of the household. Obedience training is highly recommended by
the Seller.
3)
I/we agree not to permanently confine this Great Dane with
a chain/cable/rope in my yard or in my home.
4)
I/we agree to provide a suitable inside area for this
puppy/dog when I/we must leave it unattended.
Crate training has been advised by the Seller.
5)
I/we agree not to register this puppy/dog with any other
registry other than The American Kennel Club (AKC), United Kennel Club or
Canadian Kennel Club.
6)
If the Buyer is unable to keep the above puppy/dog, the
Seller must be notified immediately and has first choice of taking the puppy
back. At the Sellers discretion, the
puppy/dog may be returned to the Seller with the AKC papers (no money will be
reimbursed) or the Seller will assist in finding a new home for the
puppy/dog. The puppy/dog may not be
sold, traded, given away or given to any animal shelter or rescue organization
without written consent from the Seller.
Buyer also agrees not to list the dog/puppy for sale, trade or to give
away or to attempt to sell trade or give away the dog without written consent
from the Seller.
7)
I/we agree to take the puppy/dog to a veterinarian within 7
days of purchase for a general check-up and stool sample check. If anything is found to be wrong with the
puppy at that time, the puppy can be replaced or returned for a full
refund. Proof must be given, by a vet,
of any problems.
8)
If Seller finds it
necessary to reclaim the puppy/dog or any legal action or lawsuit results from
this contract, all costs and attorney
fees associated with bringing and defending such litigation shall be born
wholly and exclusively by the Buyer. The
Buyer agrees any and all legal or court proceedings or cases resulting from
this contract shall be filed and held only in Genesee County Courts located in

I/we agree that if any of the above conditions are not met
by the Buyer, the Buyer agrees the puppy/dog be returned to the Seller for
proper placement. No money will be
reimbursed or refunded.

HEALTH WARRANTY: (only applies to puppies
purchased before 6 months of age)
It is agreed that your
new Great Dane puppy is covered by the following health warranty only. There is no other health guarantee other than
stated below and no verbal warranties or guarantees of health have been made by
the Seller.
If your
new Great Dane puppy should develop a life threatening inherited disease that
requires your puppy to be euthanatized with in the first 2 years of life, your
puppy will be replaced with a puppy of the same color and sex as soon as the
Seller has one available.
Or the Buyer may choose
a refund equal to one half of the purchase price instead of a replacement
puppy.
( ) If checked, your puppy is a rare and/or
unique color. Replacement of the same
color may not be available. The Buyer
than has the option to choose a puppy of another color but shall be the same
sex as the original puppy.
There will be no
refunds or reimbursement of any money for veterinarian bills or other expenses
incurred by the Buyer. All veterinarian
fees and other expenses incurred will be the Buyers responsibility.
The Seller will request
a written diagnosis from a licensed veterinarian which specifically states what
the disease is and that it is inherited and/or genetic. Seller may also request any information on
treatments that are available. All
veterinarian reports, findings, tests and x-rays must be forwarded to the
Sellers veterinarian.
The Buyer must contact
the Seller in writing before the puppy is euthanatized. If the Seller is contacted after the puppy
has been euthanatized, this health warranty is void and the puppy will not be
replaced.
The Buyer agrees to feed
the puppy a high quality, super premium food that is no higher than 24% protein
and 12% fat. . Nutri Source ~ Large
Breed Adult at 23% protein is recommended by the seller. NO supplements, calcium or vitamins other
than vitamin C are to be given to the puppy.
If the Buyer should ever have any questions on health or nutrition,
please contact the Seller.
Puppies may NOT be fed "Puppy Food" even if
it claims it is for large breed puppies.
Protein MUST be kept under 24% to ensure proper growth
in Danes. If you try to feed your
Dane the extra protein, they will not grow any larger
than normal but will grow quicker than
they should resulting in health problems.
The Buyer agrees that
he/she were informed of the dangers in feeding a puppy food, even if it is
large breed puppy food. This can cause
serious health problems down the line and health guarantee does not cover any
problems stemmed from feeding high protein food or puppy food.
Seller does not
guarantee the puppy against skin problems such as acne, demodectic mange,
allergies or etc… The health warranty
does not cover HOD (Hypertrophic Osteodystrophy), PANO (Panosteitis), OCD
(Osteochondritis Disease) or other growth related problems. No warranties or guarantees apply to health
related problems caused by nutrition or care, nor any accident or illness
contracted after delivery or possession.
This health warranty is void if any part
of this contract is breached by the Buyer.
By signing this
contract, I/we agree to allow the Seller to enter my property for the purpose
of removing this puppy/dog from my custody if I do not comply with the above
terms.
